الشروط المقترنة بعقد النكاح في الفقه الاسلامي

الملخص: تناول هذا البحث الشروط المقترنة بعقد النكاح في الفقه الإسلامي حيث تناولت في هذا الموضوع تعريف الشرط، وأنواعه، وحكم الاشتراط في العقد، ثم بينت مذاهب الفقهاء في الشروط المقترنة بعقد النكاح من المتعاقدين أو أحدهما، والأثر المترتب على العقد نتيجة الاشتراط مع إيراد الأدلة ومناقشتها والترجيح بين المذاهب في هذه المسألة، ثم ذكرت بعض النماذج لعقود اقترنت بها شروط وأثر هذه الشروط عليها، ثم ختمت بخاتمة ضمنتها أهم النتائج التي توصلت إليها.

 

Abstract: This search paper points out the conditions affiliated to marriage contract in the Islamic Jurisprudence where I tackled the definition of the contract and its type, the rule of the stating condition. I clarified the scholars' doctrines in the related conditions of the marriage contract between both of the contractors or one of them.

I also elaborated the impact of the contract due to these conditions by giving proofs, discussing them and estimating the best.

Furthermore, I mentioned some samples of contracts  connected with these conditions, trying to illustrate  the effect upon them.

I concluded with a summery containing important results that i came out with.
