أحكام الشهادة على عقد النكاح في الفقه الإسلامي

الملخص: يتناول هذا البحث موضوع الشهادة على عقد النكاح، وجاء في أربعة مباحث، ففي الأول عرفت الشهادة والنكاح، والثاني تضمن إيراداً لمذاهب الفقهاء في اشتراط الشهادة، وجاء الثالث متضمناً حقيقة الشهادة وعلى ماذا تكون؟ وفي الرابع تناولت أحكاماً متعلقة بالشاهد اعتبرها بعض العلماء وردها آخرون، ثم ختمت بخاتمة تضمنت أهم النتائج.

Abstract: This paper is about witness on marriage contract. It is divided into four parts. First, it introduces a definition of the witness and marriage. Second, it displays conditions of religious scholars on the witness. Third, it explains the authenticity of the witness and what it is about. Fourth, it tells the religious rules related to the witnessing person that some religious scholars accepted, whereas others rejected. Finally, the paper closes with conclusions of the study.
